Terms and conditions

Please read all these terms and conditions.

As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure that they contain all that you want and nothing that you are not happy with. 

1. Application

1.1. These Terms and Conditions will apply to the purchase of the services and goods by you (the Customer or you). We are trading as Tablescape.London Limited with  email address hello@tablescape.london; (the Supplier or us or we).

1.2. These are the terms on which we sell all Services to you.  By ordering any of the Services, you agree to be bound by these Terms and Conditions.  You can only purchase the Services and Goods from the Website if you are eligible to enter into a contract and are at least 18 years old.

2. Hire Services

2.2. The description of the Hire Services and any Goods is as set out in the Website, catalogues, brochures or other form of advertisement. Any description is for illustrative purposes only and there may be small discrepancies in the size and colour of any Goods supplied.

2.3. In the case of Hire Services and any Goods made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate. We will not be held responsible if details given to us are incorrect.

2.4. All Hire Services which appear on the Website are subject to availability.

2.5. We can make changes to the Services which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.

3. Basis of Sale

3.1. The description of the Services and any Goods in our website does not constitute a contractual offer to sell the Services or Goods. When an Order has been submitted on the Website, we can reject it for any reason, although we will try to tell you the reason without delay.

3.2. A Contract will be formed for the Services ordered only when you receive an email from us confirming the Order (Order Confirmation). You must ensure that the Order Confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the Order placed by you. By placing an Order you agree to us giving you confirmation of the Contract by means of an email with all information in it (ie the Order Confirmation). You will receive the Order Confirmation within a reasonable time after making the Contract, but in any event not later than the delivery of any Goods supplied under the Contract, and before performance begins of any of the Services.

3.3. Any quotation or estimate of Fees (as defined below) is valid for a maximum period of  30  days  from its date, unless we expressly withdraw it at an earlier time.

3.4. On occasion we may agree to the sale of goods if the customer wants to keep certain goods, we will review this on a case by case basis.

3.5. The description of the Goods is as set out in the Website, catalogues, brochures or other form of advertisement. Any description is for illustrative purposes only and there may be small discrepancies in the size and colour of the Goods supplied.

3.6. In the case of any Goods made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate.

3.7. All Goods which appear on the Website are subject to availability.

3.8. We can make changes to the Goods which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.

4. Fees and Payment

4.1. The fees (Fees) for the Services, the price of any Goods and any additional delivery or other charges is that set out on the Website at the date we accept the Order or such other price as we may agree in writing. Prices for Services will be calculated on a fixed price.

4.2. Fees and charges include VAT at the rate applicable at the time of the Order.

4.3. When You place an order for a Product, You authorize Tablescape.London to charge Your payment card for the Hire Fee. The hire fee is the total amount of the hire fee & any delivery charges listed.

4.4. We will charge Your payment card immediately upon order, regardless of how far in advance that Product is reserved. 

4.5. We will raise an invoice for 30% of the total order cost to act as a damage deposit. You must complete the payment of the deposit fee at least 3 working days prior to the delivery date or we cannot deliver the goods. If you make a booking within 3 working days of the delivery date, the Deposit Fee must be paid on the same day. The invoice needs to be settled by You within the time set out above, if the deposit is not paid by the deadline then We cannot deliver your order and you will not be eligible for a refund of the hire fee you have paid.

4.6. The deposit will be refunded within 5 working days of receiving the returned hired goods, once we have inspected for damages or missing items. The refund may take longer than 5 working days to appear in your bank account based on your bank.

4.7. In the event of damages or missing goods greater than the deposit fee then a further invoice will be raised to cover additional fees – these can also include late fees and additional delivery/collection costs.

5. Delivery & Collection

5.1. We will deliver the Goods or rental Services, to the Delivery Location by the time or within the agreed period. Our delivery & collection service fees are included in the price of the goods.

5.2. Delivery times may vary and any guarantee made by us are subject to delays occurring beyond our control for which we will not be responsible.

5.3. We do not generally deliver to addresses outside the UK. Please contact us for more information (hello@tablescape.london)

5.4. You agree we may deliver the Goods in installments if we suffer a shortage of stock or other genuine and fair reason, subject to the above provisions and provided you are not liable for extra charges.

5.5. Delivery of the goods occurs when the goods are delivered to the address provided by you. If you or your nominee fail, through no fault of ours, to take delivery of the Services at the Delivery Location, we may charge the reasonable costs of storing and redelivering them.

5.6. The Goods will become your responsibility from the completion of delivery or Customer collection. You must examine the Goods before accepting them. You agree to treat the products with careful responsibility.

5.7. You are responsible for any costs incurred due to failing to return goods, losses or damages. Consideration will be taken to normal expected wear and tear. If you return goods that are beyond normal expected wear and tear that are not able to be used again You agree to the charge of replacing the goods, up to the retail value of the product. This will be deducted from your deposit (as outlined in point 4.6.) 

5.8. If we are unable to collect the goods from you after your event due to you not having items ready or not being at the pick up address provided, you agree to be charged a fee for reattempted collection. This fee will be deducted from your deposit. If you prevent or delay the return of the goods to us you will be charged a late fee. There will be a fee per day for every day the goods are late.

5.9. A non return will be classed once the goods have not been returned after 14 days. In the event of a non return tablescape.london will charge you the full retail value for all goods that have not been returned.

5.10. Risk of damage to, or loss of, any Goods will pass to you when the Goods are delivered to you.

6. Intellectual Property

6.1. The Services and goods, including Tablescape.London content and all intellectual property rights, any changes or corrections are the property of Tablescape.London and are protected from unauthorized copying and distribution.

6.2. Where you have been found to have breached the terms detailed above, you hereby consent to indemnify Tablescape.London, without limitation on demand, for all resulting costs, losses and any associated legal costs, including but not limited to; costs of enforcement against you.

7. Cancellation

7.1. You may make a cancellation subject to the following policies.

7.2. If the cancellation is made 25 days before the delivery date then a full refund will be issued.

7.3. If the cancellation is made less than 25 but more than 7 days before the delivery date you will not receive a refund but will receive credit to spend at tablescape.london which can be applied to any future hire.

7.4. If the cancellation is made less than 7 days before the delivery date we are unable to offer a refund or credit.

8. Conformity

8.1. We have a legal duty to supply the Goods in conformity with the Contract, and will not have conformed if it does not meet the following obligation.

8.2. Upon delivery, the Goods will:

  • be of satisfactory quality;

  • be reasonably fit for any particular purpose for which you buy the Goods which, before the Contract is made, you made known to us (unless you do not actually rely, or it is unreasonable for you to rely, on our skill and judgment) and be fit for any purpose held out by us or set out in the Contract; and

  • conform to their description.

8.3. We will supply the Services with reasonable skill and care.

9. Successors and our sub-contractors

9.1. Either party can transfer the benefit of this Contract to someone else, and will remain liable to the other for its obligations under the Contract. The Supplier will be liable for the acts of any sub-contractors who it chooses to help perform its duties.

10. Circumstances beyond the control of either party

10.1. In the event of any failure by a party because of something beyond its reasonable control:

  • the party will advise the other party as soon as reasonably practicable;

  • and the party's obligations will be suspended so far as is reasonable, provided that that party will act reasonably, and the party will not be liable for any failure which it could not reasonably avoid, but this will not affect the Customer's above rights relating to delivery (and the right to cancel below).

11. Privacy

11.1. Any information we retain and use is strictly under the Privacy Policy (www.tablescape.london/privacy-policy)

11.2. We may contact you by using e-mail or other electronic communication methods you expressly agree to this.

11.3. Your privacy is critical to us. We respect your privacy and comply with the General Data Protection Regulation with regard to your personal information.

11.4. These Terms and Conditions should be read alongside, and are in addition to our policies, including our privacy policy (www.tablescape.london/privacy-policy) and cookies policy (www.tablescape.london/cookie-policy).

11.5. For the purposes of these Terms and Conditions:

  • 'Data Protection Laws' means any applicable law relating to the processing of Personal Data, including, but not limited to the Directive 95/46/EC (Data Protection Directive) or the GDPR.

  • 'GDPR' means the General Data Protection Regulation (EU) 2016/679.

  • 'Data Controller', 'Personal Data' and 'Processing' shall have the same meaning as in the GDPR.

11.6. We are a Data Controller of the Personal Data we Process in providing the Services and Goods to you.

11.7. Where you supply Personal Data to us so we can provide Services and Goods to you, and we Process that Personal Data in the course of providing the Services and Goods to you, we will comply with our obligations imposed by the Data Protection Laws:

  • before or at the time of collecting Personal Data, we will identify the purposes for which information is being collected;

  • we will only Process Personal Data for the purposes identified;

  • we will respect your rights in relation to your Personal Data; and

  • we will implement technical and organisational measures to ensure your Personal Data is secure.

12. Excluding liability

12.1. The Supplier does not exclude liability for: (i) any fraudulent act or omission; or (ii) death or personal injury caused by negligence or breach of the Supplier's other legal obligations. Subject to this, we are not liable for (i) loss which was not reasonably foreseeable to both parties at the time when the Contract was made, or (ii) loss (eg loss of profit) to your business, trade, craft or profession which would not be suffered by a Consumer - because we believe you are not buying the Services and Goods wholly or mainly for your business, trade, craft or profession.

13. Governing law, jurisdiction and complaints

13.1. The Contract (including any non-contractual matters) is governed by the law of England and Wales.

13.2. Disputes can be submitted to the jurisdiction of the courts of England and Wales or, where the Customer lives in Scotland or Northern Ireland, in the courts of respectively Scotland or Northern Ireland.

13.3. We try to avoid any dispute, so we deal with complaints as follows: If a dispute occurs customers should contact us to find a solution. We will aim to respond with an appropriate solution within 5 days..


 

Website terms

Consumer means an individual acting for purposes which are wholly or mainly outside his or her trade, business, craft or profession;

Contract means the legally-binding agreement between you and us for the supply of the Services;

Delivery Location means the location where the Services are to be supplied, as set out in the Order;

Durable Medium means paper or email, or any other medium that allows information to be addressed personally to the recipient, enables the recipient to store the information in a way accessible for future reference for a period that is long enough for the purposes of the information, and allows the unchanged reproduction of the information stored;

Goods means any goods that we supply to you with the Services, of the number and description as set out in the Order;

Order means the Customer's order for the Services from the Supplier as submitted following the step by step process set out on the Website;

Privacy Policy means the terms which set out how we will deal with confidential and personal information received from you via the Website;

Services means the services advertised on the Website, including any Goods, of the number and description set out in the Order;

Website means our website www.tablescape.london on which the Services are advertised.
